Acceptance of Contract
The following terms of use ("Terms of Use") are the terms of a legal agreement between you, on the one hand, and FDG Entertainment GmbH & Co.KG. (hereinafter referred to as "FDG"), on the other hand.

Illegal behavior

Inedemnification
You agree that you will be personally responsible for your use of the Sites, and that you will indemnify, defend and hold harmless FDG Entertainment GmbH & Co.KG, and its respective affiliates, employees, officers, and directors from and against any and all claims, liability, losses, damages, costs and expenses (including reasonable attorneys' fees) incurred by FDG Entertainment GmbH & Co.KG in connection with your use or alleged use of the Sites, including your conduct. FDG Entertainment GmbH & Co.KG reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with FDG Entertainment GmbH & Co.KG defense of such claim.

General Terms and conditions
This agreement is governed by the laws of Germany. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Munich, Germany, in all disputes arising out of or relating to the use of the Sites. You agree that no joint venture, partnership, employment, or agency relationship exists between you and FDG Entertainment GmbH & Co.KG as a result of this agreement or use of the Sites. FDG Entertainment GmbH & Co.KG reserves the right to disclose any personal information about you or your use of the Sites, including its contents, without your prior permission if FDG Entertainment GmbH & Co.KG has a good faith belief that such action is necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or property of FDG Entertainment GmbH & Co.KG or its affiliated companies; (3) enforce the Terms of Use; or (4) act to protect the interests of its Members or others. FDG Entertainment GmbH & Co.KG performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of FDG Entertainment GmbH & Co.KG right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Sites or information provided to or gathered by FDG Entertainment GmbH & Co.KG with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between you and FDG Entertainment GmbH & Co.KG with respect to the Sites, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and FDG Entertainment GmbH & Co.KG with respect to the Sites. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Restrictions of Liability

FDG Entertainment GmbH & Co.KG will not be liable for any damages or injury caused by, including but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure. FDG Entertainment GmbH & Co.KG will not be liable for any damages or injury, including but not limited to, special or consequential damages that result from the use of, or the inability to use, the materials in this site, even if there is negligence or FDG Entertainment GmbH & Co.KG or an authorized FDG Entertainment GmbH & Co.KG representative has been advised of the possibility of such damages, or both. The above limitation or exclusion may not apply to you to the extent that applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages. Termination
FDG Entertainment GmbH & Co.KG or you may terminate this agreement at any time. You may terminate this agreement by destroying: (a) all materials obtained from all FDG Entertainment GmbH & Co.KG sites, and (b) all related documentation and all copies and installations(together, the "Materials"). FDG Entertainment GmbH & Co.KG may terminate this agreement immediately without notice if, in its sole judgment, you breach any term or condition of this agreement. Upon termination, you must destroy all materials.

Miscellaneous
These Terms and Conditions will be governed and be interpreted pursuant to the laws of the Federal Republic of Germany, notwithstanding any principles of conflicts of law. If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. Possible evidence of use of this site for illegal purposes will be provided to law enforcement authorities. This is the entire agreement between the parties relating to the use of this site. FDG Entertainment GmbH & Co.KG can revise these Terms and Conditions at any time by updating this posting. FDG Entertainment GmbH & Co.KG products and services are available in many parts of the world. However, the FDG entertainment GmbH & Co.KG site may describe products and services that are not available worldwide.
